W.Va. PSC Approves Snowshoe Sewer Transfer
The West Virginia Public Service Commission approved the transfer agreement between the Pocahontas Public Service District and Snowshoe Water and Sewage - a private utility.
The Pocahontas Public Service District now owns and is responsible for operation of all of Snowshoe Water and Sewage collection and sewage treatment systems. This includes all liabilities - both physical and environmental - associated with these facilities.
The WVPSC order dismisses the Snowshoe Property Owners complaint against the transfer agreement.
The WVPSC order also established "Eight Rivers Safe Development, Inc. considers itself a stakeholder of the proposed project due to its concern of the potential negative impact and irreversible harm to the karst, trout habitat and groundwater, but continues to support the development and implementation of an economically justified, safe and sustainable solution." The order continues that "after careful consideration and review, the Commission determines that Eight Rivers demonstrated a valid legal interest in the present case, therefore its brief as an amicus curiae shall be accepted as filed."
